The NSW Government has passed the Work Health and Safety Amendment (Digital Work Systems) Bill 2025, obliging employers to ensure that digital work systems they use do not endanger workers’ health or safety.

The legislation also gives WHS entry permit holders the authority to request employer cooperation in accessing and inspecting digital work systems linked to a suspected breach.

What this means for members

Members are advised to exercise caution in how far they rely on AI to direct or control work processes, to avoid potential safety or compliance issues.
